Introduction

These Terms govern the use of this Application and any other related agreement or legal relationship with the Controller in a binding way. Words with an initial capital letter are defined in the relevant section of this document.

Important note: although the contractual relationship relating to purchases is entered into exclusively between the Controller and the Users, Users acknowledge and accept that, where this Application is supplied through the Apple App Store, Apple may enforce these Terms as a third-party beneficiary.

At a Glance

Use of this Application by minors is allowed only under parental or guardian supervision.
Some provisions may apply only to certain categories of Users, such as Consumers.
Access is limited to Users who meet the age requirements stated in these Terms.
Supplementary subscription terms may form part of these Terms where applicable.

Conditions of Use

Unless otherwise specified, the conditions of use set out in this section have general validity for all Users.

Requirements for use

By using this Application, Users represent that they meet the following requirements:

The User must be at least 13 years old.
Use by minors is permitted only under the supervision of parents or guardians.
The User is not located in a country subject to United States embargoes or listed as supporting terrorism.
The User is not listed on any United States government list of prohibited or restricted parties.

Registration

To use the Service, Users may create an account by providing all requested data and information in a complete and truthful manner. The Service cannot be used without opening a User account where registration is required.

Users are responsible for keeping their login credentials secure and confidential. They must choose passwords that meet the highest level of security available on this Application.

Important: by creating an account, the User accepts full responsibility for all activities carried out through their credentials. Users must immediately inform the Controller if they believe their personal information, account, credentials or other personal data have been breached, unlawfully disclosed or stolen.

Registration requirements

Accounts may not be opened through bots or other automated means.
Unless otherwise specified, each User may create only one account.
Unless expressly permitted, a User account may not be shared with other persons.

Account closure

Users are free to close their account and stop using the Service at any time by contacting the Controller through the contact details provided in this document.

Suspension and account deletion

The Controller reserves the right to suspend or delete a User account at any time, at its sole discretion and without notice, where the User's conduct is considered inappropriate, offensive, unsafe or contrary to these Terms.

Suspension or deletion of the account does not entitle the User to compensation, reimbursement or indemnity.

Content on this Application

Unless otherwise specified or clearly recognizable, all content available on this Application is owned by or provided by the Controller or its licensors.

Rights regarding content on this Application

The Controller holds and expressly reserves all intellectual property rights over the aforementioned content.

Users are not authorized to use such content in any way that is not necessary or implied for the proper use of the Service.

Restrictions of use

In particular, but without limitation, Users may not copy, download, share beyond the limits specified herein, modify, translate, transform, publish, transmit, sell, sublicense, transfer, assign to third parties or create derivative works from content available through this Application.

User-provided content

The Controller allows Users to upload, share or otherwise make available their own content through this Application.

By providing content, the User declares that they are legally entitled to do so and confirms that such content does not violate any law or third-party rights.

Rights regarding User content

The User acknowledges and accepts that by providing their own content through this Application they grant the Controller a free, non-exclusive right to process such content for the operation and maintenance of this Application.

Responsibility: the User remains solely responsible for content uploaded, published, shared or otherwise provided through this Application. The Controller reserves the right to refuse, remove, delete or block such content at its discretion.

Accessibility and profile visibility

Default public visibility: in order to allow the Service to function, content provided by the User for public profile purposes, including by way of example name, profile photo and age, may be visible to other registered Users of the Application.

Privacy management

Users may limit their visibility at any time by enabling specific privacy features available in the Application settings, such as incognito or profile visibility controls, where available.

Private content

Data that are not intended for the public profile, such as email address, phone number used for notifications and payment data, remain private and are not shared with other Users without the User's explicit consent.

Voice messages and ephemeral photos

The Application may allow Users to send voice messages and ephemeral photos in private conversations. Such content is voluntarily provided by the User and must be used lawfully, respectfully and in compliance with these Terms.

Ephemeral photos are designed for a single in-app view by the recipient. Their ephemeral nature relates to the user experience within the Application and does not constitute an absolute guarantee against screenshots, screen recording, external reproduction, legal retention obligations, technical necessity, security checks, backups or abuse investigations.

For operational, security, support, moderation, abuse-prevention or legal reasons, the Controller may process, filter, block, remove or restrict access to voice messages, images and ephemeral photos when reasonably necessary.

Acceptable use

This Application and the Service may only be used for the purposes for which they are offered, under these Terms and applicable law.

The Controller reserves the right to take any appropriate measure to protect its legitimate interests, including denying access to this Application or the Service, terminating contracts and reporting improper conduct to the competent authorities.

Behavior rules

The following are prohibited:

Pretending to satisfy access requirements or using another person's identity.
Defaming, threatening, abusing, intimidating or violating the rights of third parties.
Promoting activities that may put the User's life or that of any other User at risk.
Testing, analyzing or probing the vulnerability of this Application.
Installing, integrating, uploading or otherwise incorporating malware.
Using this Application in an abusive, excessive or otherwise inappropriate way.

Content rules

The following are prohibited:

Publishing or distributing unlawful, obscene, defamatory or otherwise inappropriate content.
Publishing content that promotes hatred, racism, discrimination, pornography or violence.
Using this Application to publish content protected by intellectual property law without authorization.
Publishing content or carrying out activities that disrupt, interrupt or damage the integrity of this Application.
Sending voice messages, images or ephemeral photos that violate the law, third-party rights, personal dignity or these Terms.
Sending sexually explicit, violent, threatening, coercive or non-consensual content, or content intended to harass, intimidate or blackmail other Users.
Attempting to bypass technical limitations of ephemeral photos, access protected files directly, extract reserved URLs, scrape content or share tools intended to bypass protections of the Service.
Recording, capturing, saving, distributing or disclosing chat content, including voice messages and ephemeral photos, in breach of law, third-party rights or the privacy expectations of the Service.

Referral program

This Application may allow Users to receive benefits if, thanks to their recommendation, a new User purchases a Product offered through this Application. The Controller reserves the right to discontinue any referral offer at any time.

Sales terms and paid products

Paid products

Some Products offered as part of the Service are paid. Prices, duration and applicable sale conditions are described in the relevant sections of this Application.

Purchase process

To purchase Products, Users may need to register or log into this Application and complete the required purchase flow through the relevant store or payment environment.

Important: in the event of termination of the agreement or closure of the account for reasons attributable to the User, any remaining virtual value or similar non-monetary balance not yet used may expire and may not be refunded.

Technical measures and service limits

The Controller may adopt technical and organizational measures to limit unauthorized access, misuse, direct downloads, capture or unauthorized disclosure of content shared through chat. Such measures, including those relating to voice messages and ephemeral photos, do not constitute an absolute guarantee against any form of copying, recording, acquisition or disclosure carried out by third parties or through means outside the Controller's control.

Common provisions

Service interruption

To ensure the best possible level of service, the Controller reserves the right to interrupt the Service for maintenance, system updates or any other changes, providing appropriate notice where feasible.

Privacy policy

Information on the processing of Personal Data is contained in the privacy policy of this Application.

Intellectual property

The intellectual and industrial property rights relating to this Application are exclusively owned by the Controller or its licensors.

Changes to the Terms

The Controller reserves the right to amend the Terms at any time. In such cases, appropriate notice of the changes will be given to Users.

Continued use of the Service implies the User's acceptance of the updated Terms. If the User does not wish to accept the changes, they must stop using the Service and may withdraw from the agreement where applicable.

Applicable law

The Terms are governed by the law of the place where the Controller is established, without prejudice to mandatory consumer protection rules that may apply.

Venue

Exclusive jurisdiction over any dispute arising from or connected with the Terms belongs to the courts of the place where the Controller is established, subject to any mandatory consumer rights.

Dispute resolution

Amicable settlement of disputes

Users may bring any dispute to the Controller, who will try to resolve it amicably.

Users may send complaints to the Controller's email address indicated in this document, including a brief description and, where relevant, the details of the affected order, purchase or account.

Definitions and legal references

This Application

The structure that enables the provision of the Service.

Agreement

Any legally binding or contractual relationship between the Controller and the User governed by these Terms.

Digital Product

A product consisting of digital content and/or a service that enables the creation, transformation, storage or access of data in digital format.

Controller

The natural or legal person that provides this Application and/or offers the Service to Users.

Product

A good or service available through this Application, such as digital files, software or booking services.

Service

The service offered through this Application as described in the Terms and in this Application.

User

Any natural person who uses this Application.

Consumer

Any User considered a consumer under applicable law.
